Attorney: Lohan stuck in Cannes, won't be in court

A lawyer for Lindsay Lohan says that the actress will miss a mandatory court appearance Thursday because she is stuck in France.

Attorney Shawn Chapman Holley, said Lohan passport was stolen when he was at the Cannes Film Festival. Holley told ABC7 that Lohan has an appointment on Thursday at the U.S. embassy to get your passport replaced.

Holley did not respond to telephone and email messages left by The Associated Press on Wednesday.

Superior Court Judge Marsha Revel ordered Lohan, 23, to appear in court in Beverly Hills for a report on his probation stemming from two arrests in 2007. Revel could issue an arrest warrant for the arrest of Lohan for missing the hearing - normal procedure when someone misses a court date.

Lohan has been on probation since pleading guilty in August 2007 of two misdemeanor counts of being under the influence of cocaine, no contest to two counts of driving with a blood alcohol level greater than 0. 08 percent and one count of reckless driving. The plea came after a couple of high profile arrests earlier this year.

Despite spending 84 minutes in jail and mandatory service in the county morgue, Lohan has fought repeatedly with the terms of his sentence. In October, a judge extended his probation for a year but a prosecutor said the actress who faced jail time if she violates her probation.

The extension was the third time that Lohan escaped punishment after her alcohol education program notified the court that the actress had violated the rules. Two cases were described as misconceptions, and the third is attributed to a busy work schedule.
